Guiding a Business Through Financial Distress and Restructuring

A company director approached Kaibe and Associates Attorneys after receiving multiple judgments and escalating pressure from creditors. The business had become unable to meet its financial obligations as they fell due, and the director faced personal exposure through signed suretyships. With employees at risk and operations grinding to a halt, urgent and strategic legal intervention was required.

We advised on the full spectrum of available options under South African insolvency law, including business rescue under Chapter 6 of the Companies Act. Business rescue proceedings were commenced, creating an immediate moratorium on legal proceedings. We engaged creditors in a structured compromise process, preserved key employment positions, and worked with the appointed practitioner to develop a post-rescue plan that was ultimately adopted by the requisite majority of creditors.
