Defending a Commercial Client Against a Contractual Claim
Our client, a business owner, was unexpectedly served with summons claiming substantial damages for an alleged breach of a supply agreement. The opposing party asserted that delivery obligations had not been met, and sought compensation that would have severely impacted the client's operations. Kaibe and Associates Attorneys was instructed immediately to assess the claim and formulate a defence.
We reviewed the pleadings and identified both substantive and procedural deficiencies in the opposing party's claim. A notice of exception was filed, which narrowed the scope of the litigation considerably. After further correspondence and pre-trial engagements, a favourable settlement was negotiated, avoiding the uncertainty and cost of a full trial, while preserving the client's commercial relationships.
Challenges
- Client served with summons on short notice with little time to respond
- Opposing party claimed significant financial damages
- Contractual terms were ambiguous and subject to competing interpretations
- Limited documentary evidence was immediately available to support the defence
- Risk of an adverse costs order if the defence was unsuccessful
Outcomes
- Exception filed on procedural grounds, substantially narrowing the claim
- Opposing party's damages figure significantly reduced through pleadings
- Favourable settlement negotiated without proceeding to trial
- Costs awarded in favour of our client
- Client's commercial reputation and relationships protected throughout
